By your use of the ViewPoint, you acknowledge that ViewPoint is an application under development that may contain inaccuracies. In addition, by your use of these resources, you agree to abide by Proper Use of Information Resources, Information Technology, and Networks at the University of Michigan (SPG 601.07) as well as the Institutional Data Resource Management Policy (601.12), in addition to all relevant state and federal laws.
You also acknowledge that we may send you communications or data regarding ViewPoint, including but not limited to: (a) notices about your use of ViewPoint, including any notices concerning violations of use; (b) updates; and (c) promotional information and materials regarding ViewPoint, via electronic mail.
You must not use ViewPoint to harm others or ViewPoint. For example, you must not use ViewPoint or information generated from ViewPoint to harm, threaten, or harass another person, organization, or the University of Michigan (U-M) and/or to build a similar service or website. You must not: damage, disable, overburden, or impair ViewPoint; resell or redistribute ViewPoint or any part of it; use any unauthorized means to modify, reroute, or gain access to ViewPoint or attempt to carry out these activities; or use any automated process or service to access or use ViewPoint.
You further agree and acknowledge that U-M will hold the copyright to any feedback you provide concerning ViewPoint, including suggested enhancements for current and future applications of ViewPoint, consistent with U-M policies including the University’s Technology Transfer Policy (SPG 303.04). In instances where U-M uses feedback you have provided to enhance ViewPoint and the implementation of this feedback could lead to substantial, material changes or new commercialization opportunities, under the University’s Technology Transfer Policy (SPG 303.04) you will not be considered an Inventor within that policy for any feedback you provide connected to your use of ViewPoint.
For University of Michigan Faculty and Staff Users
For faculty and staff of the University of Michigan, in the event that you use ViewPoint to create new copyrightable works, the copyright holder will be applied consistent with U-M policies for Who Holds Copyright at or in Affiliation with the University of Michigan (SPG 601.28) and Technology Transfer (SPG 303.04). Absent specific guidance in an existing U-M policy or separate agreement with U-M, the copyright holder will be the Regents of the University of Michigan. Additional information about when copyright would transfer back to the creator is provided in SPG 601.28 and opportunities for commercialization and revenue sharing are further detailed in SPG 303.04.
For All Other Users
You are solely responsible for all video, audio, images, text, and other content uploaded, transmitted, or created by you through or with ViewPoint (“User Content”). You represent and warrant that you own or have a license to use any User Content, and that such User Content does not violate the law or infringe, misappropriate or violate the rights, including intellectual property rights, of any other person or entity. You must remove any User Content that you no longer have the rights to. U-M has no obligation to monitor User Content and is not liable to you or to any other person or entity for any content, information or misinformation contained in any User Content. Notwithstanding the foregoing, U-M reserves the right to remove User Content without notice if it deems, in its sole discretion, that User Content violates these Terms of Service. You are solely responsible for saving, storing and otherwise maintaining copies of User Content to prevent loss.
By using ViewPoint, you grant U-M a non-exclusive, royalty-free, transferable, sublicensable, worldwide license to use, display, reproduce, modify, re-format, rearrange, distribute, and create derivative works of any User Content provided to or through ViewPoint. This license is limited to the purposes of performing research related to the effectiveness of ViewPoint, evaluating the performance of users, and making ViewPoint available to users.

U-M enforces copyright law and protects its own as well as the rights of others. If a copyright holder has a concern regarding the unauthorized use of copyrighted material on ViewPoint or any site on the umich.edu network, please contact U-M’s designated Digital Millennium Copyright Act (DMCA) agent, Sol Bermann, using the contact information provided below. U-M will only process complaints that are sent to the email address below, which has been registered with the U.S. Copyright Office.

The DMCA specifies that all infringement claims must be in writing (either electronic mail or paper letter) and must include the following:
- A physical or electronic signature of the copyright holder or a person authorized to act on his or her behalf;
- Description of the copyrighted work claimed to have been infringed, including URL of any web site;
- Description of the material that is claimed to be infringed with information sufficient to permit the university to locate the material;
- Contact information for the owner or agent, including name, address, telephone number, and email address;
- A statement that the copyright holder or authorized agent has a good faith belief that use of the copyrighted material complained of is not authorized by the copyright owner, agent or the law; and
- A statement made under penalty of perjury that the information in the notification is accurate.
